PREAMBLE

This website www.x-nomad.com (the “Site”) is operated by The Company OÜ, registered under number 953 098 183, with registered office at Narva mnt 05, 10117 Tallinn, phone number +33465844326, VAT number FR50953098183 (hereinafter the “Seller”).
In accordance with articles R. 541-167 et seq. of the French Environmental Code, The Company OÜ holds the following unique identifiers:

ARTICLE 1 – OBJECT

These General Terms and Conditions of Sale (“GTCS”) govern the rights and obligations of the Seller and any person wishing to make a purchase on the Site (the “Customer”). By placing an order on the Site, the Customer acknowledges having read and fully accepted the GTCS without reservation. By accepting these GTCS, the Customer declares having reached or exceeded the legal age of majority. The Seller reserves the right to modify the GTCS at any time, with immediate effect upon online publication.

ARTICLE 2 – PRODUCTS

The products covered by these GTCS are those listed on the Site (“Products”). Products are offered subject to availability. The Site does not guarantee stock availability. The Site reserves the right to remove any Product at any time for any reason. Product colours, features, specifications, and details are described as accurately as possible but may not be guaranteed to be complete or error-free, and digital displays may not reflect actual colours or details.

ARTICLE 3 – PRICES

Product prices are indicated in Euros, all taxes included. Customers outside the European Union may select their local currency via the dropdown menu. Prices exclude shipping fees (packaging and delivery costs). Shipping costs are detailed prior to order confirmation. Prices may change at any time but cannot be altered once the order is confirmed.

ARTICLE 4 – ORDER

Order placement:
Customers may place orders using the available catalogue on the Site. Products are added to the basket by clicking “Add to basket.” Customers must provide personal information and payment details.
Order confirmation:
An order constitutes acceptance of product prices and descriptions. After basket validation, the customer selects delivery address and payment method. The Site sends an order confirmation email. In case of unavailability of a product, the customer will be notified and offered cancellation and refund for that product. For order tracking inquiries, contact contact@x-nomad.com.

ARTICLE 5 – PAYMENT TERMS

The Site uses 3D Secure to prevent fraud. Payment methods include Visa, Mastercard, Amex, Apple Pay, Shop Pay, and Paypal.

ARTICLE 6 – DELIVERY

Products are delivered via Colissimo, DHL, or other carriers appointed by the Seller.
Delivery countries: France and worldwide.
Shipping fees and times: Details are on the “Shipping Policy” page. Times are indicative.
Incorrect addresses: The Seller is not liable for delivery failure due to incorrect or incomplete addresses. Redelivery will incur additional shipping costs.
Taxes and duties: International deliveries may incur customs duties and taxes charged by carriers, not included in prices. The Seller is not responsible for these fees. Refusal to pay import taxes may result in return shipment without reimbursement of shipping fees.
Tracking: Customers receive tracking details by email after dispatch.

ARTICLE 7 – RETURNS

Customers have a 14-calendar-day withdrawal period starting from product receipt. Products may be returned undamaged, without justification or penalty. To withdraw, customers must notify the Seller via email (contact@x-nomad.com) or postal mail, specifying the order number. Returned products must be in original packaging with accessories and returned within 14 days to the Seller’s address:
For France: Logstat SAS, 62 Boulevard Henri Navier, Lot 1.3, 95150 Taverny
For other countries: same address in France
Return shipping costs are borne by the Customer. VAT and customs duties are non-refundable. Refunds for product price and initial shipping will be processed upon product receipt and approval. Partial returns may affect refund of shipping fees. Refunds will be issued via the original payment method with confirmation email.

ARTICLE 8 – LEGAL WARRANTIES

All products benefit from the legal warranty of conformity (Articles L.217-1 et seq. Consumer Code) and warranty against hidden defects (Articles 1641 et seq. Civil Code). Customers can return defective or non-compliant products within 2 years for repair, replacement, price reduction, or contract cancellation, subject to conditions. Repairs extend warranty by 6 months. Defects appearing within 24 months are presumed to have existed at delivery unless proven otherwise.

ARTICLE 9 – EVIDENCE

Online order validation constitutes proof of the transaction as per Article 1366 Civil Code. Fraudulent use of payment card must be reported immediately. Electronic records are considered proof of transactions. Orders and invoices are archived reliably per Article 1379 Civil Code.

ARTICLE 10 – LIABILITY

Information on the Site is general and the Seller cannot guarantee accuracy or completeness. The Seller is not liable for internet service interruptions, viruses, or third-party rights infringement. Use of the Site is at the Customer’s risk. The Seller is not liable for delivery delays caused by carriers or force majeure events.

ARTICLE 11 – PERSONAL DATA

Collected personal data is processed in accordance with the Site’s Privacy Policy.

ARTICLE 12 – MEDIATION

In accordance with consumer law, the Seller adheres to the European Mediators Association (AME CONSO). Customers may contact the mediator after prior written attempts with the Seller. The European Commission’s online dispute resolution platform is also available.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

These GTCS are governed by French law. Disputes fall under French courts, subject to mandatory jurisdiction rules.
